2.1. The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers No. 4077 and the Regulation on the Principles and Procedures for the Application of Distance Contracts, regarding the sale and delivery of the product, whose characteristics, content, and sales price are specified in Articles 1.3 and 1.4 of this agreement, and which the Buyer ordered electronically from the Seller's website

If the Buyer requests delivery to a person other than themselves or to an address other than their own, delivery will be made in line with this request. Product delivery is carried out by cargo companies. The consumer must inspect the goods before receiving them and must not accept faulty or damaged goods from the cargo company official. The Buyer accepts that the product received from the cargo is sound and undamaged. The Buyer has the responsibility to inspect the goods before delivery.

4.1. Delivery costs belong to the Buyer. The shipping fee is collected during the purchase from the website. If the Seller declares on the website that they will cover the delivery fee for purchases exceeding a certain amount, then the delivery cost belongs to the Seller.
4.2. Even if the Buyer is not present at the address at the time of delivery, the Seller shall be deemed to have fully and completely fulfilled their performance. Therefore, all damages arising from the Buyer's late receipt of the product, as well as expenses incurred due to the product waiting at the cargo company and/or the cargo being returned to the Seller, shall also belong to the Buyer.

If the Seller cannot deliver the product subject to the agreement within the specified period due to reasons such as the impossibility of producing the requested product, similar commercial impossibilities, unforeseen circumstances, force majeure, or extraordinary situations preventing transportation like adverse weather conditions or interruption of transportation, the Seller is obliged to inform the Buyer. The delivery of the product subject to the agreement is conditional on the product price being paid by the payment method chosen by the Buyer. If for any reason the product price is not paid or is canceled in the bank records, the Seller is deemed to be released from the obligation to deliver the product.

5.2. After delivery, it is the Buyer's responsibility to carefully protect the product.
5.3. The Buyer undertakes not to perform any maintenance/repair on the purchased product other than the recommended care methods and not to interfere with the product beyond what is specified to them. Products damaged due to incorrect care and use will not be exchanged.
5.4. If, after delivery of the product, the Buyer's credit card is used unfairly or unlawfully by unauthorized persons due to no fault of the Buyer, and the relevant bank or financial institution does not pay the product price to the Seller, the Buyer is obliged to send the product to the Seller within 3 (three) days, provided it has been delivered to them. In this case, delivery costs belong to the Buyer.
6.1. The Seller is responsible for delivering the product subject to the agreement sound, complete, in accordance with the specifications stated in the order, and with any warranty documents and user manuals, if applicable. If the product subject to the agreement is to be delivered to a person/organization other than the Buyer, the Seller cannot be held responsible if the person/organization to be delivered to does not accept the delivery.
6.2. If the Seller believes that the performance of the product's delivery has become impossible, they shall notify the Buyer before the expiration of the performance period of the agreement. In this case, the Buyer may exercise one of the rights to cancel the order, replace the product subject to the agreement with an equivalent if available, and/or postpone the delivery period until the obstacle is removed. If the Buyer cancels the order, the paid amount and any documents will be refunded within 1-14 days.

9.1 Damaged, Defective, or Misprinted Items
Any claims for misprinted, damaged, or defective items must be submitted within 3 (three) days after the product has been received. This aligns with our commitment to address any manufacturing defects promptly.

We will conduct an assessment within two (2) business days and get back to you.
If a manufacturing defect or flaw is confirmed, we will arrange for a product exchange at Humayart's expense, including the shipping cost. We will ask you to send the product back with its original package and invoice.
9.2 Lost in Transit Claims
For packages lost in transit, all claims must be submitted no later than 30 days after the estimated delivery date. Claims deemed an error on our part are covered at our expense.
9.3 Returns Due to Incorrect Address or Unclaimed Shipments
Wrong Address: If you or your customer provide an address that is considered insufficient by the courier, the shipment will be returned to our facility. You will be liable for reshipment costs once we have confirmed an updated address with you (if applicable).
Unclaimed: Shipments that go unclaimed are returned to our facility, and you will be liable for the cost of a reshipment to yourself or your customer (if applicable).
Please note: If a returned order is due to a wrong shipping address or failure to claim the shipment, and if arrangements for reshipping are not made within 30 days, the item will be donated to charity.
9.4 Products for Which Returns/Exchanges are Not Applicable (No Right of Withdrawal)
As our products are custom-made upon your specific request and order, and customized by making changes or additions, the general right of withdrawal does not apply. This means that:
Returns or exchanges are generally not accepted based on buyer's remorse or dislike.
This also applies to products that, once unsealed after delivery, are not suitable for return due to health protection or hygiene reasons.
9.5 Customer Initiated Returns (Buyer's Remorse/Size Exchanges)
We strongly advise your customers to contact Humayart directly before returning any products. As our products are customized, we do not offer refunds for buyer's remorse. Returns for products or size exchanges are at the customer's expense and discretion. If you choose to accept such returns or offer size exchanges to your customers, you would need to place a new order at your expense for the desired product or size.
9.6 General Return Policy Guidelines
Humayart will never accept "freight collect" packages for returns.
For any valid returns, the product must be returned with its box, packaging, and any standard accessories, complete and undamaged.
If the Buyer defaults on their credit card transactions, they will pay interest within the framework of the credit card agreement they have made with the cardholder bank and will be responsible to the bank. In this case, the relevant bank may resort to legal remedies; it may demand any resulting expenses and attorney's fees from the Buyer, and in any case, if the Buyer defaults on their debt, the Buyer agrees to pay the Seller's loss and damage caused by the delayed performance of the debt.
In disputes that may arise from this agreement, the Istanbul Consumer Courts will be authorized. In locations where a Consumer Court is not available, the Istanbul Civil Courts of First Instance will have jurisdiction. For disputes up to the value declared by the Ministry of Industry and Trade, the Consumer Arbitration Committees in Istanbul will also be authorized.
The Buyer shall be deemed to have accepted all the terms of this agreement if they confirm it by clicking the "I have read and approved the Distance Sales Agreement/Pre-information Form" tab at the payment stage and if the payment for the order is made. The Seller is obliged to make software arrangements that ensure an order cannot be placed without obtaining confirmation from the Buyer that the said agreement has been read and accepted on the site.
If the order is placed, the Buyer is deemed to have accepted all the conditions of this agreement.
